>There are two separate legal instruments: 1. Mortgage Note – the loan applicants are identified as obligors for the amount of money owed on the mortgage note until it is paid in full and 2. The Deed of Trust – this is the instrument that identifies who is the owner of the home when the mortgage is all paid off. You can both owe on the mortgage note jointly with one party on title or you can both be on title with just one party on the mortgage note.
